LIMITED WARRANTY 

THIS LIMITED WARRANTY GIVES USER SPECIFIC LEGAL RIGHTS AND USER MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.  THIS LIMITED WARRANTY CAN ALSO BE FOUND IN THE DOCUMENTATION TENNA PROVIDES WITH THE GOODS. 

TENNA DOES NOT WARRANT OR GUARANTEE THAT ANY GOODS OR SERVICES PROVIDED BY TENNA WILL BE UNINTERRUPTED OR ERROR FREE. TENNA DOES NOT WARRANT OR GUARANTEE ANY RESULTS THAT MAY BE OBTAINED FROM CUSTOMER’S USE OF THE GOODS OR SERVICES PROVIDED BY TENNA.

TENNA WARRANTS THAT DURING THE WARRANTY PERIOD (DEFINED BELOW), THE GOODS PURCHASED FROM TENNA WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP.  TENNA LIMITS THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE DURATION OF THIS LIMITED WARRANTY.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO USER.

TENNA’S RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR OR REPLACEMENT AS SET FORTH IN THIS WARRANTY STATEMENT.   NEITHER ANY PERFORMANCE OR OTHER CONDUCT, NOR ANY ORAL OR WRITTEN INFORMATION, STATEMENT OR ADVICE PROVIDED BY US OR ANY OF OUR SUPPLIERS, AGENTS OR EMPLOYEES WILL CREATE A WARRANTY, OR IN ANY WAY INCREASE THE SCOPE OR DURATION OF THIS LIMITED WARRANTY.

a. Who May Use This Warranty?

This limited warranty extends only to the original purchaser of the Goods from Tenna. It does not extend to any subsequent or other owner or transferee of the Goods or any transferee.

b. What Does This Warranty Cover?

This limited warranty covers during the Warranty Period (as defined below) defects in materials and workmanship in Goods purchased from Tenna.

c. What Does This Warranty Not Cover?

This limited warranty does not cover any damages due to:

  • transportation;
  • storage;
  • improper use;
  • trackers which have not been properly installed and verified;
  • failure to follow the product instructions or to perform any preventive maintenance;
  • modifications;
  • combination or use with any products, materials, processes, systems or other matter not provided or authorized in writing by Tenna;
  • unauthorized repair;
  • Low batteries;
  • normal wear and tear;
  • Poor network or satellite reception;
  • Tenna system outages; or
  • external causes such as accidents, abuse, or other actions or events beyond our reasonable control.

Nor does this warranty cover any interruption or failure of any goods or services provided by Tenna that are caused by or result from any incompatibility of customer’s equipment or any other actions or events beyond Tenna’s reasonable control. Tenna shall have no liability for such interruptions or failures.

d. What is the Period of Coverage?

This limited warranty starts on the date of purchase and lasts for the following duration (the “Warranty Period“):

Tracker hardware equipment sold through Tenna will be sold with the warranty provided by the manufacturer, which will be provided to the User upon request, with the purchase agreement, or by User contacting the manufacturer directly.

The Warranty Period is not extended if Tenna repairs or replaces warranted Goods. Tenna may change the availability of this limited warranty at its discretion, but any changes will not be retroactive.

e. What Are User’s Remedies Under This Warranty?

With respect to any defective Good(s) during the Warranty Period, Tenna will, in its sole discretion, repair or replace such Good(s) (or the defective part) free of charge. If User returns any Goods due to an alleged defect, User shall be responsible for all shipping and handling fees for such return. User bears the risk of loss during shipment. Tenna therefore strongly recommends that Customer fully insure return shipments against loss or damage and use a carrier that can provide proof of delivery.  However, if the Goods are determined by Tenna to be in fact defective, then Tenna will refund User for the shipping and handling fees paid by User to return such Goods.

f. How Does a User Obtain Warranty Service?

To obtain warranty service, User must call or email Tenna’s Technical Support at 888-836-6269 or [email protected] during the Warranty Period to process an RMA. No warranty service will be provided without an RMA.

g. Limitation of Liability

THE REMEDIES DESCRIBED ABOVE ARE USER’S SOLE AND EXCLUSIVE REMEDIES AND TENNA’S ENTIRE OBLIGATION AND LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY.   SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO USER.

Customer acknowledges and recognizes that service interruptions, delays or errors in the telecommunications industry are often due to circumstances beyond Tenna’s reasonable control and that it is difficult to determine the cause or damages that result from such interruptions, delays or errors, therefor Tenna shall have no liability to the customer for any such damages, including but not limited to, direct, indirect, special or consequential damages, resulting from such service interruptions, unless caused by the willful misconduct of Tenna.
